What does the FL-110 Summons mean?

The family-law Summons tells the respondent that a case has started, warns what can happen without a Response and contains rules that may apply immediately.

Short answer: FL-110 is the formal notice that accompanies a divorce Petition. California Courts says it explains rights and responsibilities and what can happen if a Response is not filed within the general 30-day period. The exact timing still depends on service facts that this form alone does not prove.

What should you read on page 1?

Start by confirming the court, case number, petitioner and the name of the person shown as respondent. Page 1 also contains the response warning. A phone call or informal letter is not a filed Response.

If the names, court or case number do not match your situation, do not assume the paper is irrelevant. Verify the record with the listed court or a self-help center.

What rules can apply after service?

California Courts calls the rules on page 2 Standard Family Law Restraining Orders. Its current self-help guide says that once a respondent is served, both parties must follow restrictions that include:

  • not hiding, selling or giving away money or property outside the stated exceptions;
  • not changing certain insurance or retirement beneficiaries;
  • not taking the parties’ children out of California or applying for new passports without the required permission; and
  • not changing certain nonprobate transfers without written consent or a court order.
Read the actual form. This summary is deliberately incomplete. Page 2 of your FL-110 contains the controlling wording, exceptions and additional information. Get prompt legal help before taking an action that might conflict with it.

Does FL-110 establish your deadline?

It states the general 30-calendar-day response period after the Summons and Petition are served. But the paper itself does not establish when service legally occurred. Personal service, acknowledged mail service, substituted service and other authorized methods can create different facts about when the clock begins.

Record exactly how the papers arrived and preserve any envelope, acknowledgment or server information. If the date is close, disputed or more than 30 days ago, check with the court immediately rather than relying on a calculator.

What does FL-110 not prove?

  • It does not prove the respondent was validly served.
  • It does not prove a Response was filed or not filed.
  • It does not show that a default was entered.
  • It does not contain the petitioner’s detailed requests; those are primarily in FL-100 and attachments.
  • It is not a judgment ending the marriage.

What commonly comes next?

If you were served, California Courts directs respondents to decide whether and how to respond. The standard Response for a marriage or domestic-partnership case is FL-120. A separate Request for Order (FL-300) can add a hearing and its own response process, so check the entire packet.
